COMES NOW on this 23 th day of June 2010, the Defendant [1], Carrie Neighbors, acting
as a pro se litigant is filing a Motion to Quash the Plaintiffs Motion for Under Seal as to Defendant [1], filed on 06/22/2010, pursuant to 18 USC§ 3771. The Motion is as follows: 1). This motion is a kitchen sink motion, in which fails to specifically identify why this Motion for under seal is needed, at this point and time. Whereby, it should be quashed. 2). The Defendant [1] has a right pursuant to18 USC § 3771 not to be excluded from any court proceeding, as well as, the right from unreasonable delay, in which is not so in this matter.

3). Pursuant to President Obama's Memorandum on Transparency, this case should not be allowed to be placed under seal, due to the public has a right to know after the government had spent all the taxpayers monies on attempting to prosecute a case way beyond the statute of time limitations. Now, that the Defendant [1] had raised the proper motions and the government has failed within due diligence, to prosecute in a timely manner. the government now wants to conceal from the public the errors they have committed within this case. 4). This case was not concealed against the Defendant when the government had publicized this case on 12117/2009, even after the court ordered it not to be publicized, whereby stating it in layman's terms when it only benefits the Plaintiff, or government in this matter. Whereby, this now violates the rights of the accused to either defend or challenge the evidence or witnesses against her in a criminal prosecution, now that she is her own attorney. This is holding her to a heightened standard, as well as, confirms that she is denied equal access to justice. This is absurd at this point and time.

THEREFORE the Defendant [1], Carrie Neighbors, acting as a pro se litigant is filing a Motion to Quash the Plaintiffs Motion for Under Seal as to Defendant [1], filed on 06/22/2010, pursuant to 18 USC§ 3771, and PRAYS the Court Quash the Plaintiffs Motion to place this matter under seal as to Defendant [1] for the above referenced merits. Lanny D Welch along with Marietta Parker commit fraud against The Kansas department of Justice. In a 22 page opinion written by a Federal judge, the court informs the prosecutors Marietta Parker and Lanny D Welch that the continued litigation of charges against Guy and Carrie Neighbors is Illegal due to multiple Civil rights violations

In this opinion the federal judge outlines the case, then he exposes the attempts by the federal prosecutors to violate multiple civil rights held by the defendants Guy and Carrie Neighbors. The Judge then writes that any attempt to re prosecute Guy and Carrie Neighbors on the same charges which were previously dropped (due to a speedy trial Act (6th Amendment) violation committed by the prosecutor) would be inadmissible in court. The judge goes on to say there can be no Jury trial in a case with Civil rights violations.


Why would federal prosecutors Go against a judges Order and recharge Guy and Carrie Neighbors after the court has already observed and made a note that Guy and Carrie have had their Speedy trial Act Violated against them ?

Could it be due to the fact Guy Neighbors is a black man? Because currently he is in prison because the federal prosecutor lied to a federal judge and told him that Guy was a threat to the community when he filed a complaint against her at the department of justice for prosecutor misconduct.

Whats more interesting is how she(the prosecutor) had no prof that he(guy neighbors) has committed any violent acts against anyone. Guy Neighbors didn't even have as much as a parking ticket on his record in the last 27 years.


Judge LungStrums Order to Dismiss case against yellow house store owners Guy and Carrie NEighbors

Speedy Trial act over ruled. For Guy and Carrie Neighbors

A federal judge yesterday Ruled a continuance for a Kansas couple who have been awaiting trial for the last 5 years. Guy and Carrie neighbors Owners of the Yellow house have been accused of being at the center of the largest fencing operation of selling stolen goods in Kansas history by the Lawrence police department, yet after 5 years there has been no trial. The Neighbors maintain their innocents and claim corruption in the Lawrence Kansas police department . To which an Investigation ensued into the Lawrence police department, after the federal charges against Guy and Carrie neighbors were dismissed by a federal judge 3 years ago. This investigation was cut short after the federal prosecutor was pressured by the Lawrence police department re-file the charges against guy and Carrie neighbors in an attempt to buy time to clean up the Lawrence police department. In a recent ruling the federal judge ordered an indefinite continuance to the trial which was scheduled to take place Oct 2009.

Excerpt from motion.

The court finds that the continuance outweighs the best interests of thepublic and the defendant’s right to a speedy trial under 18 U.S.C. § 3161(h)(1)(A). The courtorders that the delay resulting from these proceedings shall be excluded, specifically the timeperiod from August 11, 2009 through the date the court conducts a competency hearing as aresult of this order for all cases, 07-20073-01,02-CM, 07-20124-01,02-CM, and 08-20105-01,02-CM as to both defendants, Carrie Neighbors and Guy Neighbors.

What this means now is no federal court trial date set for Guy or Carrie neighbors today, tomorrow, this week,this month,this year. They will be awaiting trial forever. Our 6th amendment is supposed to protect us from this.

Here are images of an innocent man who is currently incarcerated in kansas because of emails he sent to the FBI & DOJ (department of justice) in which he complains about a federal prosecutor committing crimes against him. Guy Neighbors is trying to stand up against corruption in the Kansas Department of justice and it is no easy task.

Here is a link to the Ruling in his previous case in which the Federal charges were dismissed by a federal judge. Shortly after the ruling an investigation ensued into the Lawrence police department's possible corruption. Shortly after the investigation into the Lawrence police department started the same federal prosecutor re-indited Guy and Carrie Neighbors on the same charges they were dismissed from a week earlier. This halted the lawrence police department corruption investigation as they could now claim that the investigators where interfering with an ongoing court case and criminal investigation into "the largest fencing operation in Kansas history"- SGT. All I can say is wow.....

No wonder they were trying so hard to claim Guy and Carrie Neighbors were fencing stolen goods..... They are trying to Cover their ASS , I guess if you claim someone else is committing the crimes your committing your self then you can walk scott-free ! Only as long as you can sell the lie. Looks like Time has run up for the Lawrence police department trying to sell that lie.
